The termination of parental rights (remove children from families)
The termination of parental rights (TPR) is a legal action that ends any right of parents to make decisions for a child or to care for this child.
A termination of parental rights can be voluntary or involuntary. Too Often parents are forced to abandon their rights based on allegations of abuse, neglect or abandonment. The consequences are significant and lasting. A parent should never be allowed in such procedures are not shown. The result is usually permanent.
According to Minnesota Statutes, a juvenile court may, upon request, revoke the ALL right of a parent to a child. May do:
- with the written consent of a parent, a good cause desires to terminate parental rights (Note: they want to avoid an obligation of child support is not a valid reason);
- if it is found that one or more of the following conditions:
- that the father has abandoned the child;
- that the parent has substantially continuously or repeatedly refused or neglected to comply with obligations imposed by the parent that the relationship between parents and children, including but not limited to provide the child with the adjustments necessary food, clothing, housing, education and other care and control necessary for physical health, mental or emotional development of children and, if the parent is physically or economically capacity, and either reasonable efforts by the agency work services have failed to correct conditions that formed the basis of the petition or reasonable efforts would be futile and therefore unreasonable;
- that the parent has been ordered to help to keep the child and / or financial assistance for the birth of the child and has continued to not do so without good cause. This clause should not be construed as a state of grounds for termination of parental rights of a noncustodial parent if the parent has been ordered or can not contribute financially to child support or aid the birth of the child;
- one parent is clearly unfit to be a party to the parent-child relationship due to a continued trend of certain behaviors before the child or of specific conditions directly related to
the relationship between parents and children is determined by the court to have a duration or nature that makes the parent unable, for the reasonably foreseeable future, with proper attention to the needs of children during physical, mental or emotional. Presumably the father is clearly incapable of being party to the parent-child relationship if it has been shown that the rights of children of parents of parents to one or more others have been involuntarily terminated or custody rights of parents to another child have been involuntarily transferred to a parent under section 260C.201, Subd 11, paragraph (e) of paragraph (1), or another jurisdiction similar law; - following the child's placement outside the home, reasonable efforts, under the direction of the Court, have no to correct the conditions that lead to placement. It is presumed that reasonable efforts under this clause have failed in a sample:
- (I) a child has resided outside the home of her parents by court order for a cumulative period of 12 months within the preceding 22 months. In the case of a child under eight years old when the petition was filed alleging that the child is in need of protection or services, presumably when the child has resided outside the house their parents by court order for six months unless the parent has maintained regular contact with the child and the parent is in line with the plan out of custody;
- Court approved the plan out the placement dwellings required in section 260C.212 and filed with the court under section 260C.178;

- treatment programs offered to parents were culturally, linguistically and clinically appropriate;
- whether the parent has failed two or more times to complete a treatment program or has refused at two or more separate meetings with a social worker to attend a treatment program, and
- father continues with chemical abuse.

- that the parent has been convicted of a crime listed in Article 260 012, paragraph B,
paragraphs (a) (3).
In an action involving a Native American child, Articles 260.751 to 260.835 and the Indian Child Welfare Act, United States Code, Title 25, Sections 1901-1923, control Measurement of the provisions of this article are inconsistent with those laws.
A termination of parental rights requires a high standard of proof and must be proved by clear and convincing evidence. Any person having knowledge of them might try to terminate their parental rights. The result termination is that the rights of all parents can be terminated, but does not extinguish the parental responsibility to pay the balance went from child support.
